The domestic content requirements of the Buy America Preference deriving from of the Build America, Buy America Act (“BABA”) apply broadly to ARC-funded infrastructure projects. These requirements apply to projects involving the construction, alteration, maintenance, or repair of infrastructure in sectors, including but not limited to transportation, water systems, energy, broadband, and public buildings. Generally, any project that uses ARC funding for these purposes must ensure that covered materials comply with the Buy America Preference requirements, unless a formal waiver applies.
